The estate agents legal process


Conveyancing involves legally transferring home ownership from the seller to the buyer to overall get the change in overall ownership carried out in the correct manner. Buying or selling a property involves a legal process and both the seller and the buyer need a solicitor or legal conveyancer to do the legal work. This is key as a means to ensure and make sure the sales process is a straightforward and overall correct one. This will in turn mean that both parties will be fully covered.

Find out what estate agents do, what fees are involved, dealing with sealed bids and other aspects to the best degree from and by looking at the terms / small print. You should inform your estate agent which solicitor you plan to use so that they can get the legal process well and truly underway. 

It is not against the law for an estate agent to sell a property by a tender process but it can be confusing for the seller and buyer if the agent isn't clear as to what's going on during the sale. Transparency will always make this process a great deal easier. If the solicitor has started any legal work you may also have to pay for the work. Make sure you are aware as to the terms of the process and how the legal work will be processed from a process point of view. Some estate agents are selling properties by a tender process and then there are others using the more traditional process of how general house sales tend to be processed. 

The estate agent should treat, all those involved in the proposed sale or purchase fairly. They also need to be diligent and transparent in terms of how they keep you in the loop as to whats going on during the wider overall sales process and how it is coming along in terms of timings. When the sale is on time, this can save no end of time and stress for either party. Agents have no control over the legal process but will generally assist where they can and not least in the overall communication from party to party.
